Online Terms and Conditions, Liability Waiver & Enrollment Agreement
These Terms and Conditions (“Agreement”) apply to all students, parents, and legal guardians participating in online programs, classes, workshops, camps, tutoring, robotics activities, LEGO engineering, coding instruction, and technology-related activities (“Program”) offered by Code & Bot Club.
By selecting “I Agree,” registering for the Program, submitting payment, or allowing a student to participate, the parent/legal guardian acknowledges and agrees to the following terms on behalf of themselves and the participant.
1. Participation and Assumption of Risk
The parent/legal guardian understands that participation in online robotics, coding, LEGO engineering, and technology-based instruction may involve certain risks, including but not limited to:
Trips, slips, falls, or household accidents during participation
Injuries caused by use of robotics kits, LEGO parts, tools, batteries, chargers, wires, or electronic devices
Eye strain, fatigue, repetitive stress, or discomfort from screen usage
Internet interruptions or technical malfunctions
Electrical hazards or equipment misuse
Injuries occurring while following online demonstrations or instructions
Accidental damage to personal property or devices
Participation is voluntary, and all risks associated with participation are knowingly and voluntarily assumed by the participant and parent/legal guardian.
The parent/legal guardian is solely responsible for supervising the participant’s environment and ensuring a safe space during online participation.
2. Release of Liability
To the fullest extent permitted by law, the parent/legal guardian and participant release, waive, discharge, and hold harmless Code & Bot Club, its owners, instructors, employees, volunteers, contractors, affiliates, agents, and representatives from any and all claims, demands, damages, liabilities, injuries, losses, costs, or expenses arising out of or related to participation in the Program, including but not limited to:
Personal injury
Accidents or falls
Property damage
Laptop or device usage
Robotics equipment usage
Internet or software issues
Negligence of other participants
Technical failures
Any unforeseen incident or accident occurring before, during, or after participation
This release applies to all online classes, virtual meetings, recorded sessions, communications, and Program-related activities.
3. Parent/Guardian Responsibility
The parent/legal guardian agrees that they are responsible for:
Monitoring the participant during online sessions
Providing a safe physical environment
Ensuring proper use of all devices and equipment
Supervising use of tools, robotics parts, batteries, chargers, cords, and internet access
Ensuring participants follow all safety instructions
Code & Bot Club does not provide physical supervision during online participation.
4. Technology and Device Usage
Participants may use laptops, tablets, robotics kits, software, coding platforms, internet services, and other technology tools during the Program.
Code & Bot Club is not responsible for:
Device damage or malfunction
Loss of files or data
Software errors
Internet outages or interruptions
Cybersecurity incidents
User misuse of devices or software
Damage to personal property
Injuries related to technology use
All equipment and technology are used at the participant’s own risk.
5. No Warranty
All Programs, services, materials, software, instruction, and content are provided “AS IS” and without warranties of any kind, express or implied.
Code & Bot Club does not guarantee:
Educational results
Skill improvement
Competition outcomes
Continuous access to online systems
Error-free software or instruction
Compatibility with participant devices
Uninterrupted Program access
6. No Refund Policy
ALL SALES ARE FINAL.
Code & Bot Club maintains a strict:
No refund policy
No reimbursement policy
No cancellation refund policy
No guarantee policy
No refunds, credits, transfers, or make-up sessions will be provided for any reason, including but not limited to:
Absences
Missed sessions
Scheduling conflicts
Technical issues
Internet failures
Participant dissatisfaction
Removal from the Program
Illness
Injury
Accidents
Withdrawal from the Program
7. Participant Conduct
Participants are expected to:
Behave respectfully
Follow instructor directions
Use appropriate language
Use equipment safely
Refrain from disruptive, dangerous, abusive, or inappropriate conduct
Code & Bot Club reserves the right to remove, suspend, or terminate any participant at any time for inappropriate behavior without refund.
8. Limitation of Liability
To the maximum extent permitted by law, Code & Bot Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from participation in the Program.
Any liability, if established, shall not exceed the amount paid for the Program enrollment.
9. Indemnification
The parent/legal guardian agrees to indemnify, defend, and hold harmless Code & Bot Club from any claims, lawsuits, damages, liabilities, losses, attorney fees, or expenses arising from:
Participant actions or misconduct
Violation of these Terms
Improper equipment use
Third-party claims related to participation
10. Media Release (Optional)
By participating, the parent/legal guardian grants permission for screenshots, recordings, photographs, artwork, or project images created during the Program to be used for educational, promotional, advertising, or social media purposes unless written notice opting out is provided to Code & Bot Club.
11. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain valid and enforceable.
12. Electronic Consent and Acceptance
By selecting “I Agree,” clicking acceptance online, registering for the Program, or submitting payment, the parent/legal guardian:
Confirms they are legally authorized to enter this Agreement
Acknowledges they have read and understood these Terms
Voluntarily agree to all terms and conditions
Understand they are waiving certain legal rights
Consent to the use of electronic signatures and records
